GOLF CART WAIVER AND RELEASE OF LIABILITY

This is a legally binding Unconditional and Full General Release of Liability, Waiver, Discharge, and Covenant Not to Sue MNP Venture Investments, LLC (“MNP”), Homosassa-Rentals.com, or any property owners or affiliates involved with this rental (“Hosts”).

1. DANGERS & RISKS

I, the undersigned “Operator” and/or “Lessee,” fully acknowledge that operating a golf cart on public or private roads in Citrus County, FL involves inherent risks. These risks include, but are not limited to: Injury to myself or others Damage to my property or the property of others Death or permanent disability In no event shall MNP Venture Investments, LLC, Homosassa-Rentals.com, or any associated entities be liable for direct, indirect, incidental, or consequential damages resulting from golf cart use.

2. RELEASE OF LIABILITY

I agree to release, indemnify, and hold harmless MNP, Homosassa-Rentals.com, and associated parties from any and all liability, claims, causes of action, or costs — including injury, loss, or death — arising from or connected to my use of the golf cart.

3. ASSUMPTION OF RISK

I voluntarily assume all risks associated with golf cart operation, including those resulting from my own negligence or the negligence of others. This release includes any injury, property damage, or death caused by conditions of the activity or lack of supervision.

4. LEASEE QUALIFICATIONS

I certify that I am at least 18 years old, possess a valid driver’s license, and am in good physical and mental condition to operate a golf cart. I understand that no one under the age of 18 is permitted to operate the golf cart at any time, under any circumstance, whether on public or private property. I further understand that I am fully responsible for ensuring that no unauthorized or underage person operates the vehicle during my rental period.

6. RISK ACKNOWLEDGMENT

I fully understand that: Golf cart use can result in serious injury, disability, or death Risks may be caused by my actions, those of others, or conditions of the activity Additional risks and losses may occur that are unforeseen I accept all such risks and responsibilities.

7. FULL RELEASE

I release and agree not to sue MNP Venture Investments, LLC, Homosassa-Rentals.com, their members, agents, sponsors, employees, and affiliates (collectively “Releasees”) from all liability, claims, or damages — even those caused by negligence. I also agree to indemnify Releasees against any legal claims brought by me or others on my behalf.

8. COMPLETE AGREEMENT

I understand this agreement is intended to be as broad and inclusive as permitted by law. If any portion is found invalid, the remaining terms shall continue in full force.

9. RENTAL CART AGREEMENT

I agree to be financially responsible for any damage or injury caused during my rental period. I will ensure that all members of my party understand this responsibility. I will inspect the cart at pickup and notify the owner of any pre-existing damage. Upon return, Homosassa-Rentals.com will inspect the cart.

10. RENTAL CART RESPONSIBILITY

I accept full financial responsibility for any damage to the cart, myself, my passengers, or other property during the rental period. I will not hold MNP or its affiliates liable for damages or losses.

11. AIRTAG TRACKING & TAMPERING NOTICE

Each golf cart key is equipped with an Apple AirTag tracking device to ensure the key’s safety and to monitor lawful usage of the vehicle. By checking this box, I acknowledge the presence of the tracking device and agree not to tamper with, disable, or remove it for any reason. Tampering with the tracking device may result in additional fees, rental termination, or legal consequences.

12. FUEL POLICY

I am responsible for refueling the cart as needed during my rental period.

13. ELECTRONIC SIGNATURE CONSENT

I acknowledge that I have read, reviewed, and understand the regulations outlined in the 2025 Citrus County Golf Cart Ordinance. I agree to comply with all applicable local laws and restrictions governing golf cart use throughout the duration of my rental period. I understand that failure to follow these regulations may result in fines, penalties, or termination of my rental agreement.

Citrus County Golf Cart Ordinance — Key Rules (2025)

Age & License Requirements

Under 18: Must hold a valid driver’s license or a valid learner’s driver license to operate a golf cart on county-designated roads.
18 and older: May operate with a valid driver’s license or a government-issued photo ID.
No one under 18 without a valid license or learner’s permit may operate a golf cart on public roads.

Sunrise–Sunset Operation

Golf carts may be operated only between official sunrise and sunset, unless equipped for night operation.
Night operation (sunset to sunrise) is allowed only if the cart is equipped with headlights, brake lights, turn signals, and a windshield.
Night operation is restricted to persons 18 or older with a valid driver’s license or government-issued photo ID.

Additional Key Points

Occupants are limited to the number of seats; no standing riders while the cart is in motion.
Carts must have functioning brakes, reliable steering, safe tires, a rearview mirror, and red reflectors front and rear.
Owners/operators must maintain liability insurance equivalent to a personal motor vehicle policy and carry proof while operating on county roads.
Golf carts are not permitted on sidewalks.
Violations are treated as non-criminal traffic infractions under Florida law.
